UPSC Reservation को लेकर बड़ा Supreme Court का बड़ा update

संघ लोक सेवा आयोग UPSC की परीक्षाओं में Reservation policy हमेशा से एक sensitive और confusing topic रही है।
इसी confusion को दूर करने के लिए Supreme Court ने हाल ही में एक अहम judgment दिया, जिसने UPSC selection process को लेकर कई myths को clear कर दिया।
यह judgment खासतौर पर उन candidates के लिए महत्वपूर्ण है, जो Reserved category से आते हैं और General category seat पर claim को लेकर असमंजस में रहते हैं।

Case का Core Issue क्या था?
Supreme Court के सामने मुख्य सवाल यह था कि अगर किसी उम्मीदवार ने UPSC परीक्षा के किसी भी stage पर Reservation का लाभ लिया है, तो क्या वह General category seat का हकदार हो सकता है?
Court ने इस सवाल का सीधा और स्पष्ट जवाब दिया — नहीं।
UPSC जैसी examinations में selection केवल final marks से तय नहीं होता, बल्कि यह देखा जाता है कि candidate ने पूरी selection journey में किन rules और benefits का उपयोग किया।
Supreme Court का Clear Stand
Supreme Court ने साफ कहा कि अगर किसी candidate ने Age relaxation, extra attempts, या category-wise lower cut-off जैसे Reservation benefits लिए हैं,
तो वह candidate General category seat claim नहीं कर सकता।
एक बार Reservation benefit लेने के बाद candidate उसी Reserved category channel में lock हो जाता है।
UPSC selection system में इसे fairness बनाए रखने के लिए जरूरी माना गया है।
Final Merit क्यों पर्याप्त नहीं है?
बहुत से UPSC aspirants यह मानते हैं कि अगर final merit list में marks General candidates से ज्यादा हैं,
तो General seat मिलनी चाहिए।
Supreme Court ने इस सोच को गलत बताया। Court के अनुसार, Final merit important है, लेकिन decisive नहीं। Decisive यह है कि candidate ने UPSC examination के दौरान किसी stage पर relaxed standards का फायदा लिया या नहीं।
अगर Preliminary exam में Reserved cut-off से qualify किया गया, तो Mains और Interview में अच्छा प्रदर्शन करने के बावजूद, General seat का दावा valid नहीं होगा।

Reservation Policy का Objective
Supreme Court ने यह भी समझाया कि
Reservation policy का उद्देश्य representation और opportunity देना है,
ना कि open competition में double advantage देना।
General category candidates बिना किसी relaxation के compete करते हैं। अगर Reserved candidate relaxed entry लेकर बाद में General seat ले ले, तो यह equal opportunity के principle के खिलाफ होगा।
इसी संतुलन को बनाए रखने के लिए यह judgment दिया गया।
Important Exception भी समझिए
Court ने एक जरूरी distinction भी बताया, जिसे UPSC aspirants को समझना चाहिए।
अगर कोई Reserved category candidate
पूरी UPSC selection process में
बिना किसी Reservation benefit के participate करता है,
और General cut-off से qualify करता है,
तो उसे General category candidate की तरह consider किया जा सकता है।
मतलब साफ है —
Certificate होना issue नहीं है, benefit लेना issue है।
